This End User License Agreement (“Agreement”) is a binding legal contract between you (the “User”) and A Secret Company, LLC (“Company,” “we,” “us”) regarding your use of the YourPods mobile application, web services, and related portals (collectively, the “Service”).
By installing, accessing, or using the Service, you agree to be bound by these terms. If you do not agree, do not install or use the Service.
1. Scope of License
The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Service on any Apple-branded products that you own or control (for the iOS/watchOS/macOS app) and via supported web browsers (for the web services), solely for your personal, non-commercial use, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
2. Open Source Disclosures
The App contains open-source software components.
- Source Code Availability: The source code for YourPods is available and is licensed under the GNU General Public License v3 (GPLv3).
- License Precedence: Nothing in this Agreement limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable open-source license for the underlying source code. However, the compiled App binary distributed via the Apple App Store is governed by this Agreement, pursuant to the “App Store Exception” granted by the Company in the source code license.
3. Account Types & Service Tiers
YourPods supports three modes of operation:
3.1 Local Account (No Sync)
You may use YourPods without creating an account. All data is stored locally on your device. No service agreement beyond this EULA applies to local-only usage.
3.2 Self-Hosted gPodder Sync (External Server)
You may connect YourPods to a self-hosted Nextcloud or gPodder v2-compatible server. You acknowledge that:
- Nextcloud, gPodder, and any other self-hosted sync server are Third-Party Software not developed, owned, or supported by A Secret Company, LLC.
- We do not control these services and are not responsible for their performance, availability, or security.
- You are solely responsible for the configuration, maintenance, and security of the server you connect to the App.
A Secret Company, LLC shall not be liable for:
- Data Loss: Any loss of subscriptions, listening history, or media files resulting from server crashes, database corruption, or synchronization errors.
- Server Security: Any unauthorized access resulting from weak passwords, unpatched software, or insecure network configurations.
- Compatibility: Any failure to function with modified, outdated, or beta versions of Nextcloud, gPodder, or derivative gPodder server.
3.3 YourPods Sync & YourPods Pro (Our Cloud Services)
When you create a YourPods Sync account, you agree to the following additional terms:
a. Account Creation & Eligibility
- You must provide a valid email address.
- You must be at least 13 years of age.
- You are responsible for maintaining the security of your account credentials.
- Accounts are currently created exclusively through the YourPods iOS app.

c. Subscription Terms (YourPods Pro)
Pricing
- YourPods Pro is available as an annual subscription.
- The current standard price is $30/year.
- Early Adopter accounts (accounts created before the general availability launch) are eligible for a discounted price of $20/year for the lifetime of their continuous subscription. If an Early Adopter cancels and later re-subscribes, the then-current standard price applies.
Free Trial
- Early Adopter trial: Early Adopter accounts receive a 90-day free trial of YourPods Pro when subscribing before October 1, 2026. No charge is made during the trial period.
- Standard trial: All other accounts receive a 30-day free trial of YourPods Pro.
- The trial begins when you complete the checkout process, not when you create your account.
- At the end of the trial period, your subscription automatically converts to a paid subscription at the applicable annual price unless you cancel before the trial expires.
- You may cancel your trial at any time through the Stripe Billing Portal (for web subscriptions) or through your Apple App Store subscription settings (for App Store subscriptions) at no cost.
Billing & Payment Providers
- Web subscriptions are processed by Stripe, Inc. When you subscribe through our website, you are redirected to a Stripe-hosted checkout page. Your payment details are collected and stored by Stripe — we never see or store your credit card information. Stripe handles all PCI-DSS compliance.
- App Store subscriptions are processed through the Apple App Store and managed by RevenueCat. Billing, receipts, and payment details are handled entirely by Apple.
- A subscription purchased through one platform (web or App Store) does not automatically transfer to the other. You should not subscribe through both platforms simultaneously.
Auto-Renewal & Price Changes
- Your subscription auto-renews annually at the end of each billing period.
- The renewal price may differ from your original purchase price if we have adjusted pricing for the upcoming year. Early Adopter accounts are exempt from standard price increases for the lifetime of their continuous subscription.
- We will notify you by email at least 30 days before your renewal date if your renewal price will be different from your current price. If you do not cancel before the renewal date, you authorize us to charge the then-current applicable price.
- For App Store subscriptions, Apple manages price change notifications according to their own policies.
Cancellation
- You may cancel your subscription at any time.
- Cancellation takes effect at the end of your current billing period. You retain full access to Pro features until then.
- To cancel a web (Stripe) subscription: use the “Manage / Cancel Subscription” option on your account page at account.yourpods.app, which opens the Stripe Billing Portal.
- To cancel an App Store subscription: go to Settings → Apple ID → Subscriptions on your Apple device, or visit apps.apple.com/account/subscriptions.
Refunds
- Because you have access to a free trial before being charged, refunds are generally not provided after the trial period ends.
- If you are located in the European Union or European Economic Area and have not waived your right of withdrawal, you may request a full refund within 14 days of your first paid charge by contacting support@asc.is. This right does not apply to subscription renewals.
- For App Store subscriptions, refunds are handled by Apple according to their refund policy.
d. Service Availability
- We aim to provide reliable sync service but do not guarantee 100% uptime.
- We may perform maintenance that temporarily affects service availability.
- We reserve the right to modify, suspend, or discontinue the service with reasonable notice.
e. Feature Previews
- Certain Pro features may be designated as “Feature Preview.” Feature Previews are provided as-is and may be modified, graduated to general availability, or discontinued at our discretion.
- Feature Previews are included in your Pro subscription at no additional cost. The discontinuation of a Feature Preview does not entitle you to a refund or credit.
- Feature Previews currently include: YourPods Pro Sync, Timestamped Notes, gPodder Sync Bridge, App Passwords, and Obsidian Integration.
f. Data Ownership
- You retain ownership of all data you sync through our service.
- You may export your data at any time through the account management portal.
- Upon account deletion, your data is permanently removed (subject to minimal legal retention requirements).
g. Acceptable Use
You agree not to:
- Create multiple accounts to circumvent service limits.
- Use automated tools to create accounts or access the service.
- Attempt to access other users’ data or interfere with the service.
- Use the service for any unlawful purpose.
- Share your account credentials with others or allow multiple individuals to use a single account.
- Circumvent or attempt to circumvent usage limits, including Streaming Proxy quotas.
- Resell, sublicense, or commercially redistribute access to the Service.
h. Account Termination
- You may delete your account at any time through account.yourpods.app.
- We may suspend or terminate accounts that violate these terms.
- Upon termination, your access to sync features will cease and your data will be deleted per our data retention policy.
- If you delete your account while you have an active paid subscription, your subscription will be automatically canceled and no further charges will be made. No prorated refunds are issued for the unused portion of the current billing period.
4. Privacy Preserving Playback (P3)
YourPods provides an optional feature called “Privacy Preserving Playback” (P3) that modifies podcast episode URLs on your device to bypass known third-party analytics and dynamic ad insertion services before playback or download.
By enabling P3, you acknowledge that:
(a) Some podcasts may experience playback issues if their content delivery depends on services that P3 bypasses. You may disable P3 for individual podcasts at any time. (b) P3 may reduce the reported listener counts for podcasts you listen to, which may affect those podcasts’ advertising revenue. (c) P3 does not guarantee the removal of all advertisements. Ads that are pre-recorded within the episode audio (“baked-in ads” or “host-read ads”) are not affected. (d) P3 blocks a curated list of known services that is updated periodically. Coverage is not exhaustive and new tracking services may not be immediately recognized. (e) P3 is a privacy convenience feature and is not a substitute for comprehensive network security or privacy tools such as a VPN. P3 does not encrypt traffic, anonymize your IP address, or provide protection against network-level surveillance.
YourPods provides P3 on an “as is” basis and does not warrant that P3 will block all tracking or ad insertion services, or that all podcasts will play correctly with P3 enabled.
4.1 Streaming Proxy (YourPods Pro Only)
YourPods Pro includes an optional Streaming Proxy that routes podcast audio requests through our server, so that the podcast host sees our server’s IP address instead of yours.
- The Streaming Proxy is limited to 25 uses per calendar month. Usage resets on the first day of each month.
- The Streaming Proxy is provided on an “as is” basis. We do not guarantee that all podcasts will stream successfully through the proxy, and some podcast hosts may block proxy traffic.
- Exceeding your monthly quota will result in proxy requests being declined until the next calendar month. Standard (non-proxied) playback remains available at all times.
5. No Warranty (“As Is”)
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
A SECRET COMPANY, LLC HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DATA SYNCHRONIZATION WILL BE UNINTERRUPTED, OR THAT DEFECTS IN THE SERVICE WILL BE CORRECTED.
6. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL A SECRET COMPANY, LLC BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).
CAP ON LIABILITY: IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
7. Indemnification
You agree to indemnify, defend, and hold harmless A Secret Company, LLC and its officers, directors, employees, and agents from any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with:
- Your access to or use of the Service;
- Your violation of these Terms;
- Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or
- Any dispute between you and your self-hosted server provider or any third-party podcast host.
8. External Content
The Service functions as a browser for RSS feeds. We do not control, endorse, or assume responsibility for any content (audio, text, or images) accessed via podcast feeds. You are solely responsible for ensuring that your access to and use of such content complies with all applicable laws, including copyright laws.
9. Account Management Portal
The account management portal at account.yourpods.app is part of the Service and is governed by these terms. The portal provides:
- Profile and account tier information
- Subscription management
- Password management
- Data export (GDPR compliance)
- Account deletion
Access to the portal requires authentication with your YourPods Sync credentials.
10. Web Player (YourPods Pro)
The web player at pro.yourpods.app is available exclusively to YourPods Pro subscribers. The web player is provided “as is” and subject to the same warranty disclaimers and liability limitations as the iOS/macOS app.
11. Termination
This Agreement is effective until terminated by you or the Company. Your rights under this Agreement will terminate automatically without notice from the Company if you fail to comply with any term(s) of this Agreement. Upon termination, you shall cease all use of the Service and destroy all copies, full or partial, of the App.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, USA, excluding its conflict of law principles.
